Welcome to MyShare. These Terms of Service (“Terms”) govern your access to and use of the MyShare application (“App”), website, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your account

2.1. Account creation

To use most features of MyShare, you must create an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2. Account security

You must notify us immediately of any unauthorized use of your account or any breach of security. MyShare will not be liable for any losses arising from unauthorized use of your account.

2.3. Account termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms, our Community Standards, or if we reasonably believe your account poses a risk to the safety of the MyShare community.

3. Content and conduct

3.1. Your Content

You retain ownership of the Content you post on MyShare. By posting Content, you grant MyShare a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, distribute, and display your Content in connection with operating and providing the Service.

3.2. Content responsibilities

You are solely responsible for the Content you post. You agree not to post Content that:

  • Violates any law, regulation, or third-party rights,
  • Is defamatory, obscene, threatening, or harassing,
  • Contains sexually explicit material involving minors,
  • Promotes violence, terrorism, or self-harm,
  • Constitutes spam or deceptive practices,
  • Infringes intellectual property rights of others.

3.3. Content removal

We reserve the right to remove any Content that violates these Terms or our Community Standards, without prior notice. We may also report illegal Content to law enforcement authorities.

4. Intellectual property

The Service, including its design, features, code, logos, and trademarks, is owned by MyShare and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

5. Prohibited uses

You agree not to:

  • Use the Service for any illegal or unauthorized purpose,
  • Attempt to gain unauthorized access to our systems or other users' accounts,
  • Use bots, scrapers, or automated tools to access the Service,
  • Interfere with or disrupt the Service or its servers,
  • Collect or store personal data about other users without their consent,
  • Impersonate another person or entity,
  • Use the Service to distribute malware or harmful code,
  • Circumvent any technical measures we use to provide the Service.

6. Third-party services

The Service may contain links to or integrations with third-party services. MyShare is not responsible for the content, policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to the terms and policies of those services.

7. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, MyShare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless MyShare, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your Content, or your violation of these Terms.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.

11. Governing law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Italy.
